Another Experiment

My governmental model seems to be underway, despite a few hiccups. The people even seem happy with it. I'm sure I will find out when I get shot, stabbed or otherwise mutilated that the people aren't happy.

My new experiment is with a diplomatic forum for the heads of state within Kindred Society. I don't care if they call themselves Imperitor, Prince, Citizen Prince, First Among Equals, President, etc.; it's all variations on a theme. Its up and active and I've had a few nibbles. Lets see where it goes.

Death of an ally

Things have gotten worse. It seems that Rose and her friends went back to Sacramento to confront its Prince, against better judgement. She is now in the hands of the Savage family. Rose walks into trouble and expects to be plucked out of it. She's a loudmouthed troublemaker. As a result of this fellow named DM is dead, along with several others. DM was a simple man who could be easily directed by those he trusted. DM stuck to me like glue whenever we were in the same place at the same time. I only wish he'd taken up my offer of a place to stay in Utah.

This is one of those situations that makes me wonder 'if.' Would this have happened if I had not left Modesto?

Who the hell is this Unacknowledged idiot that insults an officer of the court on an international forum? He claims titles within our Domain and I have never seen or met the man. He has one week to contact me before I provide his private haven's address to people that will bring him to me.

Princely Pondering...

I'm debating declaring us a sanctuary Domain. When other Domains go up in flames, anyone dodging the violence can come stay with us. Their covenant or clan doesn't matter, they just need to follow our Domain's rules is all. This thought came out when the sniping between the Carthians and Invictus of Los Angeles started up again. Some of my local Carthian brothers asked me to give sanctuary to any of our brothers and sisters caught in the mess. When I got elected, I pushed my idea of every individual Kindred being equal under the law. So, I will not limit it just to my Carthian brothers and sisters. To limit it so would violate my very own principles.

Legal Code of the Domain of Salt Lake

Other than a small number of Special Crimes, all Crimes are categorized by their severity. The categories are as follows; Minor, Moderate, and Major. The putative results of criminal behavior are similarly scaled as Minor, Moderate, and Major. Conviction of a Crime will result in a punishment of the same scale as the crime. Repeat offenders will be handled differently than the 'one time' offender. A third offense in the Minor or Moderate severity categories scales automatically to the next higher category. Once the criminal commits their third Major Crime, they are deemed completely unrehabilitatable and given the death sentence.

All crimes that result in a plaintiff, will be prosecuted by the plaintiff's Primogen. If the plaintiff is Unaligned or has no Primogen, the prosecutor is the plaintiff's Priscus. If there is no individual plaintiff (i.e.: against the Domain or a Masquerade Breach), the prosecutor will be the Seneschal or other designated officer of the Court.

The defendant will be represented and assisted by their Primogen. If the defendant is Unaligned or has no Primogen, they will be represented and assisted by their Priscus. If the plaintiff and the defendant are of the same Covenant, the prosecution will fall to the Seneschal or other designated officer of the Court.

The Prince sits in the role of judge. If the defendant is found guilty, the prosecutor will then recommend a sentence. The Prince will take the facts and circumstances of the case into account, as well as the prosecutor's recommendations, when deciding upon the appropriate sentence.

CRIMES

MINOR CRIMES
1. Poaching in another Clan's feeding territory
2. Theft from a Kindred
3. Murder of another Kindred's Vessel
4. Assault of a Ghoul
5. Second refusal to pay owed Prestation debt (i.e.: boons): Trivial or Minor

MODERATE CRIMES
1. Inciting unrest within the Domain
2. Masquerade breaching actions that other Kindred were forced to cover
3. Murder of a Ghoul
4. Assault of a Kindred
5. Second refusal to pay owed Prestation debt (i.e.: boons): Major

MAJOR CRIMES
1. Masquerade breach, not coverable
2. Conspiracy against the Domain and its lawful government
3. Murder of a Kindred
4. Violation of Elysium
5. Blood Bond of an unwilling Kindred
6. Second refusal to pay owed Prestation debt (i.e.: boons): Life

SPECIAL CRIMES
1. Unsanctioned Embrace (first offense is a Moderate, second offense is a Major, third offense is immediate Death)
2. Diablerie of a Kindred (Death only)
3. Refusal to pay owed Prestation debt (first offense handled by the Harpy through loss of Status, second offense is listed under crimes, third offense scales automatically to the next degree of offense)

LEVELS OF PUNISHMENT

MINOR PENALTIES (minimum status loss= 0)
1. Vitae Fine (amount determined by by judge based on circumstances of crime)
2. Surrender of Retainer/s (number and duration determined by judge based on circumstances of crime)
3. Surrender of Vessel/s (number and duration determined by judge based on circumstances of crime)
4. Prestation debt of a Trivial or Minor Boon
5. Status loss - one level

MODERATE PENALTIES (minimum status loss= 1)
1. Branding or Disfigurement (duration and severity of mark determined by judge based on circumstances of crime)
2. Eviction from Haven/s (duration determined by judge based on circumstances of crime)
3. Loss of Feeding Territory Access (duration determined by judge based on circumstances of crime)
4. Prestation debt of a Minor or Major Boon to effected party and/or the Domain
5. Status loss - one or two levels

MAJOR PENALTIES (minimum status loss= 2)
1. Exile from Domain (duration determined by judge based on circumstances of crime)
2. Torpor (duration determined by judge based on circumstances of crime)
3. Death
4. Prestation debt of a Major or Life Boon to effected party and/or the Domain
5. Status loss - two levels

Clarifications and Updates

There have been a couple requests for clarification.

1. Inciting unrest within the Domain vs Conspiracy against the Domain and its lawful government

Inciting unrest within the Domain; is the taking of intentional and willful actions that make it difficult or impossible for the Domain to perform its legal duties, resulting in the harm of its citizens. Just annoying the Court officers does not qualify.

Conspiracy against the Domain and its lawful government; this is actual planning of and/or attempts to overthrow the government. Politicking to get the Prince the boot from the joint Council meeting does not count.

2. Unsanctioned Embrace

An Unsanctioned Embrace is when a kindred makes a Childe without the approval of the Domain.

UPDATES

It is always possible when someone is not successful in one post, they may be successful in another. Cloey Ashcroft's application for the post of Herald has been accepted. Her duties have been outlined in the governmental structure document. When she makes official announcements, she speaks with my voice. Be a little more polite to her than you are to me.

The positions of Seneschal and Master of Elysium are both still open. Applications are being accepted for both, though Seneschal is seen as a higher priority. Elysium seems a near impossible concept, so long as the demons are still an issue.

I am sure the Priscus Council would like interested parties to speak with them concerning the post of Priscus Harpy.

Election and Removal of the Prince

ELECTION
The Domain will use an instant run-off voting system that allows candidates to achieve a true majority vote without the need for time consuming, separate run-off elections. When voting, each Kindred ranks the candidates from first preference to last preference. If the Kindred finds a candidate unacceptable for the position, that candidate is left unranked.

Each Kindred's voting power is weighted by their Status within the Domain. A Kindred's vote counts once for each level of status they hold within the Domain. An Acknowledged Kindred's vote counts as one vote. A Valued Kindred's vote counts as three votes.

The vote administrator is chosen by random lot from the Priscus Council with at least one witness chosen by random lot from the general population. No two of these can come from the same Covenant.

The administrator and the witness/es sort each ballot according to the first ranked selection on each ballot. If this tally indicates that more than 50% of the votes were cast for a single candidate, then that candidate wins the election.

In elections with many candidates, it is more likely for no single candidate to be ranked first on more than 50% of the votes cast. In these cases, eliminate from the election whichever candidate has the fewest number of first place votes. Strike out the name of the candidate and assign that ballot's votes to the next highest ranked candidate. Then, re-tally the votes and see if any candidate has more than 50% of the first place votes.

If two candidates are tied for the least number of votes, then the tie is broken by comparing how many votes listed the two as second place choice. If this again results in a tie, compare third and following rank choices until one receives fewer votes. At that point, eliminate the candidate and continue the tallying process.

The tallying process continues until either of the of the following events occurs:
* One of the candidates receives more than 50% of the vote and wins the election.
* All but one of the candidates has been removed, and that candidate has received less than 50% of the total vote.

If the first situation occurs, contact the winner and share the results. The candidate elect accepts the office, then notify the other candidates, and then announce the results of the election.

The second situation can occur when the voters do not rank all candidates. If this situation occurs, then the election is without a winner and it must be repeated with a new set of candidates. The previous candidates can run again, but this provides any new candidates the option to run or any of the previous candidates the option to not run.

This entire process should be completed in no more than seven calender nights, to minimize damage to the Domain and its citizens.

REMOVAL
Every four years a joint meeting of the Priscus and Primogen Councils is called to review the Prince's performance of his/her duties. They hold a vote on the Prince's tenure. With an 80% super majority vote the joint Council can remove the Prince from office, forcing a new popular election.

Should the Prince resign from office or meet Final Death while in office, an election should be immediately called. Should the Prince be incapacitated for an extended time, an election should be called after the third month of incapacitation. During the Prince's time of inability to perform his/her duties, the Seneschal shall act as the Prince's proxy.

Domain Governmental Structure

PRINCE
Membership: One individual with the political and physical prowess to hold the position, once put in place by popular acclaim.
Powers: Holds Domain over the entire Domain, Right of Destruction, Right of Progeny, ability to call the Blood Hunt, ability to modify the standing of the citizens of the Domain, final arbiter on points of law and disputes between citizens of the Domain, and has the ability to grant the Rights of Destruction, Progeny and Domain to others. Can ratify or veto new laws.
Responsibilities: Final judicial arbiter and Head of State.
Restrictions: Subject to review by a joint meeting of the Priscus and Primogen Councils every four years. Cannot be Harpy.

SENESCHAL
Membership: One individual selected by the Prince.
Powers: Vets requests for formal access to the Prince and acts as the Prince's proxy when the Prince is not present.
Responsibilities: Schedules formal Court events and appointments with the Prince. Acts as the Court's point of contact and handles the concerns of the Unaligned.
Restrictions: Does not have the Rights of Destruction, Progeny or Domain and cannot grant these Rights to others. Can be removed from office at any time by the Prince.

HERALD
Membership: One individual selected by the Prince.
Powers: Speaks with the Prince's voice on official announcements.
Responsibilities: Makes official announcements of the Court on the electronic forums and at Domain events. Maintains a full census of the Domain's citizens and their dependents; including Clan membership, Covenant membership, and Domain Status.
Restrictions: Has no judicial or enforcement powers. Can be removed from office at any time by the Prince.

SHERIFF
Membership: One individual selected by the Prince.
Powers: Enforces the Law and the Prince's judicial decrees. Can designate Deputies.
Responsibilities: Investigating crime, maintaining the Domain's peace, and organizing the Domain's defense against external threats.
Restrictions: Does not have the Rights of Destruction, Progeny or Domain and cannot grant these Rights to others. Can be removed from office at any time by the Prince.

MASTER OF ELYSIUM
Membership: One individual selected by the Prince.
Powers: Enforces the rules of Elysium with status gains and losses, as well as through other means.
Responsibilities: Maintaining the peace of Elysium and organizing social events for the Domain.
Restrictions: Enforcement powers are only for protecting Elysium and does not have the Rights of Destruction, Progeny or Domain and cannot grant these Rights to others. Can be removed from office at any time by the Prince.

PRISCUS COUNCIL
Membership: One individual from each recognized Clan within the Domain; selected by the Clan's own rules and methods.
Powers: Recommend Clan based feeding territories to the Prince and can select a Priscus Harpy. Has joint meeting with the Primogen Council every four years to review the Prince's performance of the duties of Praxis. Can remove the Prince during these meetings with a 4/5 majority vote. Others as determined by their Clan internally.
Responsibilities: Assist the Sheriff in enforcing the Law within their Clan's feeding territories. Others as defined internally by their Clan. Must keep an accurate census of their Clan within the Domain and regularly provide the Herald with this information. Others as determined by their Clan internally.
Restrictions: Do not have the Rights of Destruction, Progeny or Domain and cannot grant these Rights to others. Enforcement powers are only effective within their Clan's feeding territory. Cannot vote for the Priscus Harpy if also a member of the Primogen Council. Cannot be Harpy. Can be removed by their Clan at any time.

PRIMOGEN COUNCIL
Membership: One individual from each recognized Covenant within the Domain; selected by the Covenant's own rules and methods.
Powers: Prince's council of advisers. Has joint meeting with the Primogen Council every four years to review the Prince's performance of the duties of Praxis. Can remove the Prince during these meetings with a 4/5 majority vote. Can override the Prince's veto of a legal amendment with a unanimous vote. Others as determined by their Covenant internally.
Responsibilities: Legislative branch. Provide a point of contact for their Covenant members to bring concerns to the Prince. They are the voice of the people within their Covenant. Must keep an accurate census of their Covenant within the Domain and regularly provide the Herald with this information. Others as determined by their Covenant internally.
Restrictions: Do not have the Rights of Destruction, Progeny or Domain and cannot grant these Rights to others. Unaligned may not use any member of the Council to access the Prince. Cannot be Harpy. Can be removed from office by their Covenant at any time.

PRINCE'S HARPY
Membership: One individual selected by the Prince.
Powers: The ability to modify status.
Responsibilities: Keep an accurate and up to date log of the Domain's status as well as Prestation debts owed by and to the citizens of the Domain. Regularly provide the Herald with the status information.
Restrictions: Does not have the Rights of Destruction, Progeny or Domain and cannot grant these Rights to others. Powers can only effect status. Cannot be Prince, Priscus or Primogen. Can be removed from office by the Prince at any time.

PRISCUS HARPY
Membership: One individual selected by the Priscus Council.
Powers: The ability to modify status.
Responsibilities: Keep an accurate and up to date log of the Domain's status as well as Prestation debts owed by and to the citizen's of the Domain. Regularly provide the Herald with the status information.
Restrictions: Does not have the Rights of Destruction, Progeny or Domain and cannot grant these Rights to others. Powers can only effect status. Cannot be Prince, Priscus or Primogen. Can be removed by the Priscus Council at any time.
